Privacy policy

1. The short version

• We don't sell your personal information. Not to advertisers, not to data brokers, not to anyone.
• Dealer offers are opt-in. If you let local dealers make you an offer, they never get your contact details unless you reply and choose to share them.
• We collect what we need to run the marketplace: your account details, your listings, and your messages.
• We use one cookie, to keep you signed in. No advertising or tracking cookies.
• Dealers own their dealership's data. We only use it to run the service for them.

2. What we collect

• Account details: name, email, password (stored only as a one-way scrambled "hash", never the password itself), and optionally business name, phone, town and ZIP code.
• Listings and machine records: the machine's ID number, brand, model, year, hours, condition, price, photos, description and ZIP code. Machine records, including the machine's ID number, are public and permanent; they describe the machine, not you.
• Messages and offers you send through TorquePower, and reports you send us about listings.
• Saved machines and saved searches, so we can show them to you and send the alerts you asked for.
• Dealer offers: if you switch on "Let local dealers make me an offer" for a listing, the offers dealers send you and what you do with them (reply, decline). For dealers: the offers you send and what you want to buy (distance, brands, kinds of machine).
• Free valuations: the machine details you enter, and your email and ZIP code if you ask for dealer offers.
• Dealer Platform data entered by dealers: customers, machines they own, deals, service and parts.
• Billing: for dealers, Stripe handles card details. We receive only the plan, status, and the last digits and expiry of the card if Stripe shows them.
• Basic technical logs: like every website, our hosting provider records things like your network address and browser type to keep the site secure. We keep a scrambled version of the network address with reports and sign-in attempts to stop abuse.

3. How we use it

• To run the marketplace: show listings, keep machine records, deliver messages and offers, and give free valuations.
• To send the emails you'd expect: account and security emails, messages from buyers and sellers, and alerts you turned on.
• To keep TorquePower safe: stop scams, spam, stolen machines and password guessing.
• To improve TorquePower, using totals and trends rather than looking at individuals.

4. Who we share it with

• Other users, when you choose: a seller sees your name and message when you write to them; a dealer sees your contact details when you ask them for an offer or send a form on their website.
• Dealer offers (only if you switch them on): dealers within the distance they chose see your listing's machine details, its machine record, the asking price, roughly how far away it is and how many dealer offers it has had. They never see your name, email or phone. A dealer sees your name and message only when you reply to their offer, and your email and phone only if you tick "share my phone/email with this dealer". Switch dealer offers off any time from My listings or the link in every offer email. Dealers pay TorquePower for the chance to send an offer, never for your information.
• Service providers who help us run TorquePower, only for that purpose: hosting and storage (Cloudflare), payments (Stripe), and email and text delivery. They may not use it for anything else.
• When the law requires it, or to protect people from fraud or harm.
• If TorquePower is sold or merged, your information would move with it under this same policy, and we'd tell you first.
• We do not sell or rent personal information, and we don't share it for advertising.

5. Cookies

TorquePower uses one cookie, named tp_session, to keep you signed in for up to 30 days. It holds a random code; we store only a scrambled copy of it. It is not used for tracking or advertising. Signing out removes it.

6. Email and text alerts

We send alerts (saved-search matches, price drops, messages) only when you ask for them. Every alert email has a link to stop it, and you can manage alerts on your account pages. Text messages are sent only if you give your number and agree to texts; message and data rates may apply, reply STOP to stop and HELP for help. Agreeing to texts is never a condition of buying anything.

Sample and demo accounts never send emails or texts to real people.

7. Dealer data

Customer records a dealer keeps in the Dealer Platform belong to that dealer. We process them on the dealer's behalf, keep them separate from other dealers, and never sell them or use them to market to that dealer's customers. A dealer can ask us to export or delete their data. If you are a dealer's customer and want your information changed or removed, contact the dealer, or us and we'll pass it on.

8. How long we keep it

We keep account information while your account is open. Machine records are kept permanently, because the record belongs to the machine; your personal details are removed from them if you close your account. Messages are kept while either person's account is open. Logs are kept only as long as needed for security.

9. Your choices and rights

You can see and change your details on your account pages, turn off alerts, and close your account. You can also ask us for a copy of your information, to correct it, or to delete it, by emailing [FILL IN: contact email, e.g. help@ your domain]. Depending on where you live, you may have more rights under your state's law; we honor them. We won't treat you differently for using them.

10. Security and children

We protect information with encryption in transit, scrambled passwords and session codes, and limits on who can see what. No system is perfect; if something goes wrong that affects you, we'll tell you.

TorquePower is not meant for children under 13, and we don't knowingly collect their information.

11. Changes and contact
